Terms of Service
By using the twiddish.com web site and/or the Twiddish mobile application, a service of StewartSoft, LLC, you are agreeing to be bound by the following terms and conditions ("Terms of Use").
Basic Terms
1. You are responsible for any activity that occurs under your screen name.
2. You are responsible for keeping your password secure.
3. You must not abuse, harass, threaten, impersonate or intimidate other Twiddish users.
4. You may not use the twiddish.com service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
5. You must limit the scope and subject matter of your postings and contributions on twiddish.com to material that is dish/entrée/food related.
6. You must limit any accolades or criticisms to the dish/entrée/food item you are reviewing. General comments about the restaurant, service or any other topic not related to the dish/entrée/food item you are reviewing in your contribution are strictly prohibited.
7. Your use of Twiddish is strictly non-commercial. You may not use Twiddish as a means to promote a business or in an attempt to damage a business.
8. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, links ("Content") that you submit, post, and display on the twiddish.com service.
9. You must not modify, adapt or hack twiddish.com or modify another website so as to falsely imply that it is associated with twiddish.com.
10. You must not create or submit unwanted email to any Twiddish members ("Spam").
11. You must not transmit any worms or viruses or any code of a destructive nature.
12. You must not, in the use of Twiddish, violate any laws in your jurisdiction (including but not limited to copyright laws).
Violation of any of these agreements will result in the termination of your twiddish.com account. While twiddish.com prohibits such conduct and content on its site, you understand and agree that Twiddish cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the twiddish.com service at your own risk.
General Conditions
1. We reserve the right to modify or terminate the twiddish.com service for any reason, without notice at any time.
2. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via Internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
3. We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time.
4. We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party\s intellectual property or these Terms of Use.
5. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.
Copyright
The accuracy and utility of Twiddish is dependant on the content that is generated by you the user. Any and all Content submitted/uploaded, including but not limited to images (including photographs and pictures) and text, on twiddish.com or thorough the twiddish.com mobile application immediately becomes the sole property of Twiddish once submitted. By participating in the Twiddish community, you acknowledge and understand that we may use any Content that you have submitted/uploaded without any obligation to compensate you for the use of that Content.
In addition:
1. By submitting/uploading an image to Twiddish you agree to relinquish any claim of ownership, including but not limited to copyright, of that image. You also acknowledge that once submitted/uploaded to Twiddish the image becomes the property of Twiddish and that Twiddish may use that image in any manner it seems fit, including but not limited to commercial purposes not directly related to the operation of Twiddish. Moreover, by submitting an image to Twiddish you disclaim any right to royalties or other compensation as a result of Twiddish’s commercial or non-commercial use of that image. Notwithstanding any rights that Twiddish may have upon your submission, Twiddish will not prevent you from using the original or copies of the images you have submitted for your own personal or commercial use. However, since the image is now the property of Twiddish you may not attempt to sell rights to or allow others to use the image without the express written consent of Twiddish. For the purposes of this section an image may be defined as any visual depiction including but not limited to photographs, drawing or other graphic descriptions.
2. By submitting/uploading text to Twiddish you agree to relinquish any claim of ownership, including but not limited to copyright, of that text. You also acknowledge that once submitted/uploaded to Twiddish the text becomes the property of Twiddish and that Twiddish may use that text in any manner it seems fit, including but not limited to commercial purposes not directly related to the operation of Twiddish. In the event that Twiddish chooses to use text that you have authored for purposes other than that which you submitted the text, Twiddish will do so in a manner that does not attribute the text to you, thus protecting your privacy.
3. If you choose to remove your Twiddish profile, Twiddish retains the rights to continue using your user generated Content, including but not limited to images and reviews, as part of its database, provided that such content will no longer be attributed to your profile. Since your submissions become the property of Twiddish, Content removed from the Twiddish database will not be removed upon your discontinuation of your Twiddiish account.
4. Twiddish undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:
1. A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
2. A description of the copyrighted work claimed to have been infringed;
3. A description of the infringing material and information reasonably sufficient to permit Twiddish to locate the material;
4. Your contact information, including your address, telephone number, and email;
5. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
6. A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.
